Terms and Conditions

1. Who we are and what these terms cover

JoTrack is a fleet management and vehicle tracking service operated by Sama Lel Itisalat Co. (trading as Sama Telecom), a limited liability company registered in the Hashemite Kingdom of Jordan under commercial registration number 10542, with its registered office at Zahran Street, Building 159, Amman, Jordan. In these terms, "we", "us" and "JoTrack" mean that company; "you" means the organisation or individual subscribing to the service.

These terms govern your subscription to the JoTrack platform. By creating an account, starting a trial, or subscribing, you agree to them. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it.

Our Privacy Policy and Refund Policy form part of these terms.

2. The service

JoTrack is provided as software as a service, hosted by us and reached through a web browser and our mobile applications. Depending on the plan you choose it may include live vehicle tracking, trip history, driver behaviour scoring, geofencing, maintenance reminders, reporting, and AI assistant and agent features.

The features included in each plan, and any usage allowances attached to them, are those described on our pricing page at the time you subscribe.

3. Free trial

We offer a 14-day free trial. No payment details are required to start it and no charge is made during it. At the end of the trial your workspace becomes inactive unless you subscribe. We may withdraw or change trial terms for future customers at any time.

4. Subscription term and automatic renewal

Subscriptions run for the term you select at checkout: monthly, quarterly, half-yearly or annually. Unless you turn it off, your subscription renews automatically for a further term of the same length at the end of each term, and the payment method on file is charged.

You may turn off automatic renewal at any time from My Subscription in your account. Your plan then stays active until the end of the term you have already paid for, and is not billed again. We send reminders by email before a renewal falls due.

5. Prices, payment, and our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all orders. Paddle handles payment, billing enquiries, invoicing and refunds, and its buyer terms apply to the payment itself alongside these terms.

Prices are stated in US dollars and are those shown at the time you place your order. We may change our prices for future terms; where a price change affects a renewal we will tell you at least 30 days before it takes effect, and you may turn off automatic renewal if you do not wish to continue.

6. Taxes

Paddle calculates, collects and remits any sales tax, VAT or equivalent due on your purchase, based on your billing location. Where you are required by local law to withhold tax on a payment, the amount payable to us is the amount stated, and any withholding is your responsibility.

7. Cancellation and refunds

You may cancel automatic renewal at any time as described in clause 4. Refunds are governed by our Refund Policy: in summary, a full refund is available within 14 days of your first payment, and renewal payments are not refundable. Paddle may also refund a payment in accordance with its own buyer terms.

8. Your account

You are responsible for keeping account credentials confidential and for all activity under your account. Tell us promptly at Info@jotrack.com if you believe an account has been compromised. You are responsible for the users you invite into your workspace and for their compliance with these terms.

9. Acceptable use

You agree not to:

• use JoTrack to track a person or a vehicle without the lawful basis to do so, including any notice or consent your local law requires of an employer;
• resell, sublicense or provide the service to a third party except as expressly agreed with us in writing;
• attempt to gain unauthorised access to the platform, to other customers’ data, or to our infrastructure;
• reverse engineer, copy or create derivative works from the platform;
• use the service unlawfully, or in a way that damages or overloads it.

Vehicle tracking is regulated differently from country to country. Ensuring your use complies with the employment, privacy and data protection law that applies to you is your responsibility, not ours.

10. Your data

You retain ownership of the data you and your vehicles generate. You grant us the licence needed to host, process and display it in order to provide the service, and to produce aggregated, anonymised statistics that do not identify you, your drivers or your vehicles.

For telematics data collected from your vehicles you are the data controller and we act as processor on your instructions. How we handle personal information is set out in our Privacy Policy.

On request within 30 days of your subscription ending, we will provide an export of your data in a machine-readable format. After that period we may delete it.

11. Our intellectual property

The JoTrack platform, its software, design, documentation and trade marks remain our property. Your subscription grants a non-exclusive, non-transferable right to use the service during your term, and nothing more.

12. Availability and support

We aim to keep JoTrack available at all times, but we do not guarantee uninterrupted service. We may suspend access for planned maintenance, and will give reasonable notice where we can.

Support is available by email at Info@jotrack.com. Response targets, where a plan includes them, are those stated on the pricing page.

13. Tracking hardware

Tracking devices, sensors and accessories are sold or leased separately from your subscription and are not billed through Paddle. Hardware is paid for offline, by cash on delivery or bank transfer, and is subject to its own terms of sale and manufacturer warranty. A subscription does not include hardware unless we have agreed so in writing.

14. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, if payment fails and is not resolved, or if we are required to by law. Where the breach can be put right we will tell you and give you a reasonable opportunity to do so first.

You may stop using the service at any time by turning off automatic renewal. Termination does not entitle you to a refund except as set out in our Refund Policy.

15. Warranties and liability

JoTrack is provided on an "as is" basis. We do not warrant that the service will be error-free, that location data will be accurate at all times, or that it is fit for any particular purpose you have not told us about. GPS accuracy depends on satellite coverage, mobile network availability and the hardware installed, none of which is entirely within our control.

To the fullest extent permitted by law, our total liability to you in connection with the service in any twelve-month period is limited to the fees you paid us in that period. We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data beyond our obligation to maintain reasonable backups.

Nothing in these terms excludes liability that cannot lawfully be excluded.

16. Changes

We may change the service, and these terms, from time to time. Where a change materially reduces the service or your rights we will give you at least 30 days’ notice by email or in the application before it takes effect. Continuing to use JoTrack after that date means you accept the change.

17. Governing law and disputes

These terms are governed by the laws of the Hashemite Kingdom of Jordan, and the courts of Amman have exclusive jurisdiction over any dispute arising from them. We would always rather resolve a problem directly, so please contact us first.
